Terms of Use
These terms govern your use of mio: the app for iPhone and Apple Watch, its other apps and the website and web dashboard at https://mio.fitness (together, «mio» or «the service»). By creating an account or using mio you accept these terms and confirm you have read the Privacy Policy (https://mio.fitness/en/privacy). If you don't agree, don't use mio. If the Spanish and English versions differ, the Spanish version prevails.
In short: mio is a training and nutrition tool, not a medical service. Coaches are independent and mio doesn't charge for coaching. In-app purchases are charged by Apple or Google Play, depending on the store you downloaded mio from, and subscriptions renew until you cancel them. The mio Coach subscription you purchase on the web is billed through Stripe. We have zero tolerance for offensive content and abusive users.
1. Who we are
mio is a service of Alexis Lomeli Mejia, an individual («mio», «we» or «us»). For any matter related to these terms, including legal notices, write to soporte@mio.fitness.
2. Your account and minimum age
- You must be at least 16 to use mio. When you create your account we ask you to confirm your age; if we find you are under 16, we delete the account. If you are a minor under the laws of your country, you also need your parent's or guardian's permission.
- You sign in with Apple or Google. Your account is personal: don't share or sell it, and protect access to your device and your Apple or Google account.
- The information you provide must be true and up to date, especially your age and the data your targets and your coach rely on.
- The same account can use mio to train and as a coach.
3. What mio is
mio lets you create and follow routines, log workouts and food, see your progress, connect with coaches and take part in a community. Some features require a paid plan, device permissions (such as Apple Health, the camera or the microphone) or your permission to use AI. The Apple Watch app needs an iPhone with mio signed in.
We improve mio constantly, so we may add, change or remove features. If we remove an essential feature of an active paid plan, we will let you know in advance. We don't guarantee that mio will work without interruptions or errors, or any specific physical results.
4. Health and safety
- mio is not a medical service or a medical device, and it doesn't diagnose, treat or prevent disease. Content from mio, from the AI and from your coach is informational and for fitness purposes.
- See a doctor before starting an exercise or eating program, especially if you have an injury or a health condition, are pregnant or take medication. Stop if you feel pain, dizziness or shortness of breath.
- Calorie and macro targets are calculated with reference formulas (such as Mifflin-St Jeor) and never go below a safe minimum of 1,200 kcal a day. Apple Health data and mio's calculations (calories, targets and loads) are estimates.
- The supplements you log in mio are only your own record: mio doesn't recommend them or suggest doses.
- In an emergency, call your local emergency services (911 in Mexico). mio is not an emergency channel.
5. Artificial intelligence features
- AI features are optional and only work if you allow them in Profile › Settings › AI privacy. They use OpenAI models; the details are in the Privacy Policy.
- You can use the AI from age 16. If you are 16 or 17, it works with limits: nutrition assistance doesn't propose a calorie deficit or supplements, and we recommend reviewing your plans with your parent or guardian and a health professional. The same limits apply to what your coach generates for you.
- AI can make mistakes, leave out information (for example, an allergen) or give results that aren't right for you. Review any result before following it: it is not medical, nutritional or professional advice. If an answer seems wrong or harmful, report it from the app.
- Don't use the AI for illegal or harmful purposes, to obtain information about other people or to create content that breaks section 11. Don't include other people's data in your requests. We automatically check the text of the routine chat and the AI Coach to stop harmful content.
- AI features have usage limits that depend on your plan and may change.
6. Coaches and coaching
- Coaches are independent professionals. They are not employees, agents or representatives of mio. mio doesn't verify their degrees, certifications or experience, unless the app expressly says otherwise, and doesn't supervise their routines, plans or advice.
- The fee a coach shows is a reference they set themselves. mio doesn't sell coaching, doesn't charge, process or broker payments between coaches and clients, and isn't a party to that agreement. Price, payment method, refunds and any disagreement are settled between you.
- The subscription a coach pays to mio for their mio Coach plan is a separate service, subject to sections 7 and 8. That charge does not include or process payments their trainees make to them for coaching.
- If you are a coach, you agree to: have the training and licenses your activity requires; be truthful in your profile; use your clients' data only to coach them, confidentially and lawfully; not ask for payments or sensitive data through messages for purposes other than coaching; respect your clients' decision not to share certain data, and take special care with clients aged 16 or 17, for whom mio doesn't allow AI to propose a calorie deficit or supplements.
- If you record a person's information in mio before they have an account (for example, when you see them in person to invite them by email), you declare that they gave it to you themselves and agreed that you record it, and you only use mio's AI features with that information if they also agreed to that. If they don't accept your invitation, mio deletes that information within the periods in the privacy notice.
- The routines and plans you deliver to a trainee stay in their account, also if you archive the routine or the coaching ends; after it ends they no longer receive your changes. The month recaps you send them also stay with them, even if the coaching ends or you delete your account (then, without your name). Your payments with the trainee never open or close that content.
- Either of you can end the coaching at any time in the app: the client in Fitness › My coach and the coach from the client's page. When it ends, the coach stops seeing the client's data.
- Coach reviews must be honest and based on your real experience.
7. Subscriptions and purchases in the app and on the web
In-app purchases are charged by the store you downloaded mio from, under its terms: on iPhone and iPad, Apple, through its in-app purchase system; on Android, Google Play, through its billing system. Prices are shown in the app, in your storefront's currency; depending on your country, they already include taxes or the store adds them at checkout.
Available subscriptions (all monthly and auto-renewable):
- mio Pro: unlimited guided workouts, full history, advanced analytics and 3 AI routines every month.
- mio Ultra: Pro's unlimited guided workouts, full history and advanced analytics, plus AI tools for training and nutrition subject to a monthly AI usage balance, which its AI routines are also deducted from (section 9).
- mio Coach Starter, Coach Pro and Coach Max, for coaches: client capacity, a place in the directory, monthly AI credits for your clients and mio Pro included for you and your clients; your clients' Pro doesn't come with AI routines, because you build their routines (section 8). Starter may include a 7-day free trial.
Apple and Google Play purchases: renewal and cancellation:
- Payment is charged to your Apple Account or Google Play account when you confirm the purchase.
- The subscription renews automatically for the same period and price until you cancel it. With Apple, cancel it at least 24 hours before the current period ends: the renewal is charged within the 24 hours before the period ends. With Google Play, cancel it before the renewal date.
- You can manage or cancel it in Profile › Settings › Subscriptions in mio or in the store where you bought it: on your iPhone or iPad, in Settings › [your name] › Subscriptions; on Android, in the Google Play Store app › your profile › Payments & subscriptions › Subscriptions. If you cancel, you keep the benefits until the end of the paid period.
- The free trial, when offered, is available once per Apple Account or Google account, under each store's rules. If you don't cancel it in time (with Apple, at least 24 hours before it ends), it becomes a paid subscription. Any unused part of the trial is forfeited when you buy another subscription in the same group.
- If a subscription's price changes, Apple or Google Play will notify you before charging the new price, under their rules; if those rules ask you to accept it and you don't, the subscription ends at the end of the paid period.
- Deleting your mio account or the app does not cancel a subscription purchased through Apple or Google Play: cancel it in the store where you bought it.
Refunds for Apple and Google Play purchases: the store decides them under its policies, and if it refunds a purchase, we remove the corresponding benefit. For Apple purchases, request them at https://reportaproblem.apple.com; mio can't refund purchases made with Apple. For Google Play purchases, request them in Google Play under its refund policies (https://support.google.com/googleplay/answer/2479637); if those policies refer you to the developer, write to us at soporte@mio.fitness.
Your purchase and your mio account: each subscription, from Apple or Google Play, is linked to the mio account that bought it, and «Restore purchases» recovers it on that account. An Apple member subscription (Pro or Ultra) can be moved to another mio account up to twice in 365 days; Google Play subscriptions and coach subscriptions can't be moved between accounts. mio purchases aren't shared through Apple's Family Sharing or Google Play's Family Library.
Web subscriptions to mio Coach:
- On the web, you can purchase a monthly mio Coach Starter, Coach Pro or Coach Max subscription. Stripe processes the payment. Before you confirm, the checkout page shows the plan, amount, currency and billing interval. The subscription renews automatically each month until you cancel its renewal.
- Starter may offer a 7-day free trial when your account meets the requirements shown at purchase. The checkout page shows whether the trial applies and when billing starts. If you do not cancel before the trial ends, the subscription becomes a paid subscription.
- You can manage or cancel renewal through «Manage subscription» in Settings › Subscription of the mio Coach web dashboard, which opens the Stripe portal. Cancellation of renewal takes effect at the end of the current period; you keep the corresponding benefits until then. Deleting your account has a different effect, explained in section 15.
- There are no refunds for partial periods: if you cancel renewal, you keep your plan until the end of the paid period. If you see a charge made in error or twice, write to us at soporte@mio.fitness and we will review it. This does not limit the rights applicable law gives you.
- The web subscription is linked to the mio account used to purchase it and cannot be transferred to another account. Sign in with that same account to access its benefits. Purchases made through Apple or Google Play continue to be managed in their store.
8. Coach plans, AI credits and included Pro
- Capacity: each plan allows a maximum number of active clients. If your plan expires or you downgrade, nobody is removed, but you can't accept new clients until you have room.
- Directory: you only appear in the coach directory while you have an active plan and room available.
- Plan credits: each calendar month (UTC) you receive a pool of AI credits to generate content for your clients. Unused plan credits expire at the end of the month.
- Credit packs: they are consumable purchases and never expire. They are used after the plan credits and only while you have an active coach plan. They have no monetary value and can't be transferred or exchanged for money. If Apple or Google Play refunds a pack, we deduct its credits, which may leave your balance negative and pause the AI until it recovers.
- Each AI use deducts credits according to its actual cost. If a generation fails after the provider has already processed it, its cost may not be refunded.
- Included Pro: while your coach plan is active, you and each of your current clients get mio Pro at no additional cost. Your clients' mio Pro doesn't include AI routines: you build their routines. If the plan or the coaching ends, each account goes back to the plan it pays for itself or to the free plan.
9. Free plan and limits
The free plan includes unlimited manual routines, up to 3 guided workouts per week and 3 AI routines in total, not per month. A mio Pro subscription includes 3 AI routines every month; in mio Ultra, AI routines are deducted from its monthly AI usage balance. If your mio Pro comes only from your coach's plan (section 8), it does not include AI routines: your coach builds your routines. While you have an active coach plan, your own AI routines are deducted from your plan's credits (section 8). We may adjust the free plan's limits and will let you know in the app before reducing them.
10. Your content
- You own the content you create or upload (routines, notes, photos, posts and messages).
- To operate mio you give us a non-exclusive, royalty-free, worldwide license, limited to the time the content is on mio, to host, reproduce, technically adapt (for example, compress images) and show it to the people your settings allow. If you make a routine public, other people can save and use it, and those copies may remain even if you delete yours.
- You confirm that you have the rights to the content you upload and that it doesn't infringe third-party rights or these terms.
- If you give us suggestions, we may use them without any obligation to you.
11. Community rules: zero tolerance
mio has zero tolerance for objectionable content and abusive users. You may not post, send or share:
- Sexual content, nudity or the sexualization of anyone, and any content that sexualizes minors or puts them at risk.
- Harassment, bullying, threats, hate speech or discrimination for any reason.
- Graphic violence or the promotion of dangerous behavior, self-harm or eating disorders.
- The sale or promotion of drugs, controlled substances or prescription medication, including anabolic steroids.
- Spam, scams, impersonation, fake accounts or manipulation of reviews, followers or reactions.
- Other people's personal data without their permission, or content that infringes copyright, trademarks or other rights.
- Illegal content or content that incites crime.
How we enforce these rules:
- We automatically filter text and images before they are published; if they break these rules, they aren't published.
- You can report any post, comment, story, message, review, profile, public routine, photo, coaching request or month recap from its «…» menu › Report, or by writing to soporte@mio.fitness. Reported content is hidden from you immediately and, if several people report it, from everyone while we review it.
- You can block anyone from their profile («…» › Block) or right after reporting them: they stop seeing your content, following you and messaging you and, if they are a coach, inviting you. If you block your coach, the coaching ends and their month recaps stop being shown. You can unblock in Profile › Settings › Blocked people.
- We review reports within 24 hours. We remove content that breaks these rules and suspend or permanently ban whoever posted it. A ban doesn't cancel your Apple or Google Play subscription: cancel it in the store where you bought it. If you think we made a mistake, write to soporte@mio.fitness.
- Intellectual property notices: if you believe content infringes your copyright or trademark, write to soporte@mio.fitness with the subject «Intellectual property», the link to or description of the content, your contact details and the basis of your right. We will review it and, if appropriate, remove it.
12. Acceptable use
You may not access mio by automated means (bots or scraping) or try to extract other people's data; bypass limits, payments or security measures; reverse engineer the app, unless the law allows it; interfere with the service or someone else's account, or use mio for unauthorized commercial purposes, such as sending unsolicited advertising.
13. Third-party services
mio integrates with third-party services such as Apple Health, Google Maps Platform, YouTube and OpenAI. Their use is also subject to their own terms: by watching videos in mio you agree to the YouTube Terms of Service (https://www.youtube.com/t/terms), and city search is subject to the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/) and the Google Privacy Policy (https://www.google.com/policies/privacy). We aren't responsible for third-party services' content or availability.
14. mio's intellectual property
mio, its logo, design, software and own content belong to Alexis Lomeli Mejia or its licensors. We grant you a personal, limited, revocable, non-exclusive and non-transferable license to use the app on the devices you own or control, under these terms and the usage rules of the store you downloaded it from (Apple or Google Play). You acquire no other rights.
15. Suspension and termination
- You can stop using mio and delete your account whenever you want in Profile › Settings › Account › Delete account or at https://mio.fitness/eliminar-cuenta. Deletion is permanent; the Privacy Policy explains what is deleted and what may be kept.
- We may suspend or terminate your account, or limit features, if you break these terms, if the law requires it or to protect other people or the service. When reasonable, we will let you know and explain why.
- Suspending or deleting an account doesn't cancel Apple or Google Play subscriptions: cancel them in the store where you bought them.
- If you delete your mio account, we immediately cancel the web subscriptions associated with that account through Stripe before completing the deletion. They do not wait until the end of the current period. Deleting the app or no longer using it does not delete your account or cancel those subscriptions; to cancel renewal only, use «Manage subscription» as described in section 7.
16. Warranties
We provide mio with reasonable care, but to the extent the law allows it is offered «as is» and «as available», without guaranteeing that it meets your goals or that content from coaches, other people or the AI is accurate. Nothing here limits the rights consumer protection laws give you.
17. Limitation of liability
To the maximum extent the applicable law allows, mio won't be liable for indirect damages, lost profits or data loss arising from the use of mio, or for injuries or damages arising from following routines, plans or advice from coaches, other people or the AI, or for agreements between coaches and clients. Our total liability to you is limited to what you paid for mio in the 12 months before the event that gave rise to it. These limitations don't apply in cases of intent or gross negligence, or where the law doesn't allow liability to be limited.
18. Additional terms for the app downloaded from the App Store
- These terms are between you and mio, not Apple. mio, not Apple, is solely responsible for the app and its content.
- The license in section 14 lets you use the app on Apple-branded products you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. Apple's standard End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies; if there is a conflict about the app's license, the latter prevails.
- Apple has no obligation to provide maintenance or support for the app; we provide support at soporte@mio.fitness.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the app's purchase price, if any; to the extent the law allows, Apple has no other warranty obligation regarding the app.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection or similar legislation, or for investigating, defending, settling or discharging third-party intellectual property infringement claims. Those claims are our responsibility.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a «terrorist supporting» country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- When using the app you must comply with applicable third-party terms, such as your wireless data service agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, Apple will have the right to enforce them against you as a third-party beneficiary.
19. Changes to these terms
We may change these terms. We will publish the current version at https://mio.fitness/en/terms with its date and, if the change is important, notify you in the app or by email at least 15 days before it applies. If you keep using mio after that date, the change applies to your use; if you don't agree, you can delete your account. Changes that affect the processing of your sensitive data will require your consent again in the app.
20. Governing law and disputes
These terms are governed by the federal laws of the United Mexican States, without prejudice to the mandatory consumer protection rules of the country where you live, which you always keep. If you are a consumer in Mexico, you can contact the Federal Consumer Protection Agency (Profeco). Unless the law gives you the right to go to the courts where you live, disputes will be settled before the competent courts of Mexico. If any part of these terms is found invalid, the rest remains in force.
